SPRO TERMS OF USE
1. GLOSSARY
1.1 App or application: refers to SPRO.
1.2 Mobility Services of BSM and / or AMB: indicate the services associated with the urban distribution of goods accessible from the SPRO application, which are provided by Barcelona de Serveis Municipals, SA and/or the Metropolitan Area of Barcelona, within the framework of the collaboration agreement between AMB, AMB Information, Barcelona City Council and B:SM, for the Metropolitan Parking Platform. These services are: DUM.
2. SPRO TERMS OF USE
Barcelona de Serveis Municipals, SA (hereinafter, "B:SM") is the provider of the mobile application called SPRO (hereinafter, the application "), with CIF A-08765919.
These terms of use regulate the rules of use of the mobile application for the area of urban freight distribution (hereinafter, “SPRO” or “Service”) in that B:SM is the provider of the aforementioned mobile application. Specifically, the operational aspects of the application derived from the use of the application for smart mobile phones are regulated.
The terms that regulate the application and which are structured in the following points are described below:

2.1 Access to the application
- The application requires the use of compatible smartphones, the installation of the Mobile Application and Internet access (subject to the connection fees that your provider may apply for which B:SM is not responsible and fully indemnified). Some of the features of the application may not be used in areas without mobile coverage and / or when telephone data services are not activated. In this case, the user declares to know and accept that the use of the application will not be completely complete, as they cannot receive the notices sent to the device or connect to the celery provided by the web services or other services. B:SM will not be responsible, in any case, for the problems caused by the elimination or deactivation of access to any of the services.
- Proper use of the application may require obtaining software updates, for that reason the user must always install and use the latest version of the Mobile Application.
- To download and install the SPRO application and to consult the different mobility services, it will not be necessary to register to SPRO.
- However, in order to access the service, it is essential to REGISTER and CREATE A SERVICE ACCOUNT.
- When the application is downloaded, the user will have to explicitly accept the terms of use and the privacy policy.
- SPRO services are aimed at any person of legal age, the user being responsible for complying with the requirements for the use of the mobility services provided. Any use of the Services by the user is subject to compliance with current regulations that apply.
- By downloading and using the SPRO application, the user states and guarantees that they have sufficient capacity to enter into this agreement.
- SPRO may collect certain information automatically, which includes, among others, the type of device it uses, the ID of its mobile devices, the operating system, the type of internet browser it uses and information on its use of the service. The application collects information about the location of your mobile device (see section 2.5 Location).
- The user can uninstall the application at any time in accordance with the procedure provided in the operating system of her/his device.
2.2 Registration to the application
- To register the SPRO application as a user, all contact details must be provided, including personal (NIF) or social identification (CIF), full name and, if necessary, the reason social, an own and valid email address, and a mobile phone number.
- You will also have to activate your Account by accessing the confirmation page that will be linked to the email that B:SM will send to the email address registered during the registration procedure. If the user does not access this link, their Account will not be activated, since the electronic address provided cannot be verified and this will be considered incorrect.
- The account owner can choose between two types of registration: (i) Personal account, (ii) Business account. The Personal Account allows parking with only one vehicle at a time. The Business Account allows several users to park.
- The Administrator User of a Business Account is responsible for entering the email address and for modifying or deleting the identifying data (name or alias), and the restrictions (vehicles, parking conditions, etc.) of the Mobile Users.
- The Administrator User of the Business Account may make use of the user area to the Website to create additional Mobile Users to his Business Account, subject to the procedure set forth below: The Administrator User will provide B:SM with the email of the Potential users and BSM will send potential users a link through which the user will have to register the application by providing their own NIF, password and accepting the terms of use of the service and the privacy policy.
2.3 Use of the Mobile Application
- To use the Service, System Users will have to download and configure the Mobile Application and log in with their Access Data.
- The SPRO application is operational without logging in, but with limited functionality.
- The functionalities available without logging in are: visualization of the location of the different parking areas, as well as information about them; map navigation; provision of free parking spaces regulated.
- The functionalities that require you to be logged in are the following: parking start, vehicle management, notifications, etc.
- The User can configure the reception of notifications and notices related to the parking in progress through the Mobile Application.
- These notices, despite being configured, may not be received by Mobile Users for reasons not attributable to B:SM (for example, due to lack of connectivity, sufficient battery, etc.).
- The User of the Service can obtain a digital ticket through the mobile application, after downloading and configuring the application itself on a compatible device.
- The User of the Service can only obtain valid digital tickets to park in the DUM zones, of those vehicles that according to the current Municipal Ordinance 3.2 are authorized to use these places. For this purpose, B:SM will have access to the data of authorized vehicles as Responsible for the treatment in order to check the authorized vehicles for parking of the aforementioned parking spaces.
- The download, registration, use and maintenance of the Mobile Application is completely free and can be done through the official mobile application markets by the smartphone operating systems compatible with it. B:SM reserves the possibility, prior notification, to modify these conditions at any time, giving the user the possibility of accepting or rejecting them. In any case, it will be necessary for the user to accept the new terms of use to continue using the service.
2.4 Suspension
- The improper, incorrect or inappropriate use of the application, or the falsification of the data may result in the temporary or definitive blocking of the use of the application.
2.5 Location
- The user accepts that the SPRO application collects information about the location of their mobile device, and will need their mobile device to be on, activated and with coverage, for its operation.
- Location data will be processed by B:SM anonymously in order to improve its services or for mobility-related purposes.
- The user may at any time revoke the consent of the activation of the location service through the corresponding option of her/his device.
- In the case of revoking the consent of the activation of the location service, the use of the application will be incomplete, since some services will not be operational.
2.6 Intellectual property rights
- SPRO belongs to Barcelona de Serveis Municipals, SA (hereinafter B:SM), with CIF A-08765919 and registered office in Barcelona, C / Calabria 66, 08015 Barcelona, Registered in the Mercantile Registry of Barcelona at volume 34702, folio 138, sheet B-108.458. It is a public company wholly owned by the Barcelona City Council that aims to manage several mobility services.
2.7 Update and modification of the terms of use
- B:SM reserves the possibility to review and modify these legal terms at any time. The user is subject to the policies and terms in force at the time she/he uses the service, unless otherwise indicated by law or decision of the competent body. Any modification of these terms of use will be notified to the user and, in any case, their acceptance will be necessary to continue using the service.
2.8 Procedure for suggestions, queries and complaints
- For any suggestion, query, complaint or claim, the user can go to the technical support section of the mobile application or to the contact section of the website.
3. DUM SPECIFIC TERMS OF USE
SPRO services are addressed to any person of legal age, the user being responsible for complying with the requirements for the use of the mobility services provided. Any use of the Mobility Services by the user is subject to compliance with current regulations that apply.
3.1. Parking conditions
- To start the service, the user will have to stand next to the vehicle and request the start of parking. Then the user will have to indicate the license plate of her/his vehicle and the code of the area where he/she wants to park, which will be found at the vertical sign.
- The parking time will be calculated with the start/stop mode, so that the User will have to indicate both the time of arrival and the time of leaving the parking space through the mobile application.
- A Mobile User can only have one simultaneous parking operation. It is not allowed that the same User can have two simultaneous parking operations, even for different vehicles or places.
- Although the mobile application will facilitate and assist the User in the selection of the parking conditions in the area, the user is ultimately responsible for the parking conditions indicated in her/his parking request: zone code, time conditions, maximum time, etc.
- Any mistake made by the user in the conditions of the parking operation indicated may result in the penalties established in current legislation.
- The digital Ticket does not exempt compliance with the time limits of the place occupied by the Service User. The use of the parking lot having expired this anticipated time or having exceeded the maximum time allowed may be penalized. Concatenation of parking lots within the same zone code is not allowed.
- B:SM can reject a parking request for several reasons that, in any case, will be indicated to the Mobile User. As an example, for parking conditions, out of service, etc.
- The User is responsible for verifying if their parking request has been accepted or rejected. In the event that the request is rejected, the user will receive a notice from her/his device. The confirmation of the acceptance of the request will be displayed because the calculation of the parking time will start in the application.
- The inability to view information or receive notices about the current digital Ticket in the mobile application does not exempt the obligations towards the regulated parking space. This includes any cause or technical incident outside of B:SM and/or AMB, which can be adduced to the mobile device itself (status, configuration, battery, device malfunction, etc.) or to the telecommunication channels or operators.
- In the start/stop mode, to stop the current parking time, the User must be located next to the space where she/he has the vehicle and with the mobile application she/he must send a request to end the parking of the current operation.
- The User is fully responsible for maintaining her/his own mobile phone in good condition and with sufficient battery to ensure that she/he can finish the parking tickets started in start/stop mode. If in spite of all this happened, the user could use any other compatible mobile device, download the mobile application, start the session and then indicate the end of the parking of the current operation.
- The user will receive a Ticket on their mobile in which she/he will indicate the start time and the end time of the parking and zone code.
- In case of loss or theft of the mobile phone, the Account Administrator User will have to notify to her/his telephone operator and may perform the operation from another device.
